Lois Mermerstein is a patent attorney and former engineer who focuses her practice on intellectual property and technology matters, including patent prosecution and litigation. She is also active in several American Bar Intellectual property matters, primarily patent prosecution for smaller entrepreneurial clients.

Ms. Mermerstein has expertise and experience in patent prosecution, including streaming video, graphics, and computer hardware and software, for clients ranging from established publicly-traded hardware and software providers to small businesses and experienced solo inventors. She has been deeply involved in intellectual property litigation, including patent portfolio evaluations and pre-filing research; drafting of complaints, briefs, motions, infringement contentions, discovery and discovery responses, claim construction briefs, and license agreements; settlement negotiations and other interactions with opposing counsel; trial schedules; coordination with experts; case management.

Representative matters on which Lois has worked include an engagement as a sole associate on an MMS messaging matter for a plaintiff patent holder, responsible for case management and all accompanying motion practice from pre-filing investigation through claim construction. She has worked as a sole associate on an RFID matter for a plaintiff inventor, responsible for case management and all accompanying motion practice from pre-filing investigation through filing of initial complaints. She has also worked as an associate on an matter involving server power management for a plaintiff patent holder, responsible for pre-filing investigation, infringement contentions, and other technology-related duties through initial claim construction briefing and settlement.

Ms. Mermelstein has professional abilities in business, technology, and intellectual property law, for businesses ranging from closely-held entities to global publicly-held corporations. Representative matters for which she has demonstrated her skill include: (a) Patents: initial applications, foreign patent conversions, responses to USPTO office actions; (b) E-commerce and general business: trademark/domain name dispute resolution, multistate LLC formation and operations, formation and operations; and (c) E-discovery: document review for litigation.

She has researched and drafted briefs, conducted depositions and an ALJ hearing, and developed cases to help disabled coal miners obtain federal Black Lung benefits. Lois has designed and implemented communications protocols, air quality sensors, and digital signal processing applications. Ms. Mermelstein has written functionality tests and did failure analysis of pre-silicon x86 processors. Professional development has been a keen interest for Lois. To this end, she has served as a CLE Speaker on “Smart Contracts” and “Understanding Drone Privacy Law Regarding Unmanned Aerial Vehicles.”
